The legislature sees drugs as the direct cause of the majority of criminal activity, and therefore the penalties for crimes related to drugs increase with the quantity of drugs and intent. In the state of Florida, drug offenses will usually fall into one of three categories:
•Drug Possession
•Drug Dealing (Includes sale and/or delivery)
•Drug Trafficking
Of these three categories, drug trafficking is the most serious criminal felony offense charge. Trafficking includes importation, sale, or delivery of a controlled substance, with intent to deliver. This can be inferred from quantity of drugs in your possession.
The following drugs are considered controlled substances and therefore simple possession is a criminal offense:
•Club drugs
•Marijuana
•Crack
•Cocaine
•Heroin
•Ecstasy
•Meth/methamphetamines
•Hallucinogens
•Controlled substances without a prescription (i.e. Xanax or painkillers)
•Rohypnol
