Breaking a lease in Quebec is not always simple because most leases are legally binding for their full term. However, there are legal ways to end a lease early.
Option 1: Lease assignment
You can transfer your lease to another tenant. If approved:
The new tenant takes over your lease
You are released from obligations
Importantly, landlords cannot refuse without a valid reason.
Option 2: Subletting
You may sublet your unit if your landlord agrees:
You remain responsible for the lease
The subtenant pays rent to you
Option 3: Special circumstances
You may be allowed to end a lease early if:
You are moving into senior housing
You experience domestic violence
The home becomes uninhabitable
You have serious medical reasons
If you leave without approval:
You may still owe rent
The landlord can claim damages
